Terms of Service

Welcome to Yoria. These Terms of Service ("Terms") govern your access to and use of the Yoria mobile application, the website at yoria.app, and related services (together, the "Service"), operated by Yoria ("Yoria", "we", "our", or "us").

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using Yoria, you represent that you are 18 or older and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and the organization.

2. Your account

You may sign in using Apple, Google, email, or any other supported method. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please notify us promptly at support@yoria.app if you suspect unauthorized use.

You agree to provide accurate information and to keep it up to date. We may refuse to create, suspend, or terminate accounts that contain inaccurate information or that violate these Terms.

3. The Service

Yoria is an AI character companion. You can chat with characters in multiple modes, build long-term memory and intimacy, pin story events, and receive Letters from characters. We may add, remove, or change features at any time. Some features may depend on your language, region, app version, or content preferences.

4. Gems, purchases, and refunds

The Service uses an in-app currency called gems. Gems are used to send messages and access certain features. New accounts receive a starter gem balance, and additional gems are awarded through actions such as daily check-ins or purchased through your app store.

• Gems have no cash value, are not redeemable for money, and are non-transferable between accounts.
• Purchases are processed by your app store (Apple App Store, Google Play, or another platform). Their billing terms and refund policies apply.
• Promotional gems may expire or be subject to additional terms disclosed at the time of the promotion.
• We may, at our discretion, adjust gem balances to correct errors, address abuse, or comply with law.

Where required by law, you may be entitled to a refund within a defined cancellation period. Outside those cases, gem purchases are generally non-refundable once delivered.

5. AI-generated content

Character replies, Letters, summaries, notes, and other automatically generated content are produced by AI models. They are works of fiction and may be inaccurate, inconsistent, or unexpected. AI-generated content is not professional advice and should not be relied on as such (including medical, legal, mental health, financial, or safety advice).

You are responsible for your own decisions and for how you choose to interact with the Service.

6. User-generated content

You may create custom characters and submit other content (collectively, "User Content"). You retain ownership of the User Content you submit, but you grant Yoria a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, display, distribute, and use that User Content to operate, provide, improve, and promote the Service.

You represent and warrant that:

• You own or have the rights necessary to grant the license above.
• Your User Content does not infringe any third-party intellectual property, privacy, or publicity rights.
• Your User Content does not violate these Terms or applicable law.

Public characters are reviewed by us before becoming visible to other users. We may reject, remove, or unpublish any User Content at any time, including content that does not pass review or that we believe is harmful, infringing, or otherwise inappropriate.

Reporting and blocking. The app provides built-in tools to keep the community safe: you can flag any character or content you find objectionable, and you can block a creator so that their content is immediately removed from your feeds and search results. We review reports of objectionable content and act on them within 24 hours, including removing the violating content and, where appropriate, ejecting the user who provided it.

7. Mature content and safety

Yoria supports controlled mature (NSFW) content. Access to mature content requires:

• Confirming you are 18 or older.
• Explicitly opting in within Settings.
• Compliance with per-character rating and moderation rules.

By default, accounts only see SFW content. You can disable mature content at any time. You agree not to attempt to bypass age gating, opt-in controls, or moderation systems.

The Service does not allow content that sexualizes minors, depicts non-consensual acts as desirable, promotes self-harm or suicide, encourages real-world violence, or violates applicable law. See the Acceptable use section below.

8. Acceptable use

We have zero tolerance for objectionable content and abusive users. Content or behavior that violates this section may be removed without notice, and accounts responsible for it may be suspended or terminated.

You agree not to use the Service to:

• Violate any law or third-party right, including intellectual property, privacy, and publicity rights.
• Submit, generate, or solicit content that sexualizes minors, includes non-consensual sexual content, promotes terrorism, extreme violence, self-harm, or hate.
• Harass, threaten, dox, or harm any person.
• Attempt to identify real individuals from AI-generated content or use the Service to impersonate a real person without their consent.
• Use the Service to provide professional advice (medical, legal, financial, mental health) to others as if from a qualified professional.
• Reverse-engineer, scrape, or extract data from the Service, except as permitted by law.
• Interfere with the Service's operation, security, or other users' use.
• Use the Service to train competing AI models without our written permission.
• Bypass safety, age, payment, or moderation systems.

9. Intellectual property

The Service, including its software, design, brand, official characters, prompts, and content (other than User Content), is owned by Yoria or its licensors and is protected by applicable laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

"Yoria" and related marks are our trademarks. You may not use them without prior written permission, except for fair-use references such as factual statements about the Service.

10. Suspension and termination

You may stop using the Service at any time and may delete your account from within the app. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us, or engaged in fraudulent or abusive conduct.

On termination, unused gems may be forfeited to the extent permitted by law. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE OR ANY AI-GENERATED CONTENT WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR SECURE.

To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YORIA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE DURING THAT PERIOD, OR (B) USD 50.

13. Indemnification

You agree to defend, indemnify, and hold harmless Yoria and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Yoria is established, without regard to its conflict-of-law principles. To the extent permitted by law, any dispute arising under these Terms will be resolved exclusively in the courts located in that jurisdiction.

Nothing in these Terms limits any mandatory consumer rights you have under the law of your country of residence.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by other reasonable means before the change takes effect. The "Last updated" date at the top of this page shows when these Terms were last revised. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
